Illegal Loans Are Increasingly Urged, OJK Strengthens Consumer Protection Certainty 

Jakarta, The PRAKARSA - The Financial Services Authority (OJK) is increasingly prioritizing consumer protection with the issuance of OJK Regulation No. 22 of 2023 concerning consumer and public protection in the financial services sector. 

On December 22 2023, OJK issued POJK PKM which is an improvement to POJK Number 6/POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector. 

The ResponsiBank Indonesia Coalition appreciates this policy improvement and hopes that financial services consumers will be increasingly protected, especially when it comes to protecting personal data from being caught by illegal loans. 

It is hoped that these improvements can encourage the creation of a reliable consumer protection system, increase consumer and community empowerment, and increase awareness of financial services business actors (PUJK). Improvements are made to create a financial system that grows sustainably and stably, and is able to protect the interests of consumers and society in response to the increasingly complex and dynamic development of the financial services industry. 

This policy is intended to strengthen aspects of complaint services, consumer services by OJK, as well as consumer rights and obligations. "We hope that the protection of consumer data will be increasingly guaranteed, that in the future there will be no more consumer data being spread, that firm action and the imposition of legal sanctions on parties proven to have distributed personal data can be implemented," said Eka Afrina Djamhari, Researcher at The PRAKARSA, Friday (12/01). 

Complaints must be made easier and handled quickly, "hopefully fewer people will be caught in debt, it will be easier to report if there are indications of fraud and the handling will also be fast," added Eka. 

Throughout 2023, OJK has received 23.064 complaints. Meanwhile, the OJK's Task Force for Eradicating Illegal Financial Activities (Satgas PASTI) has stopped 2.248 illegal online loans consisting of 40 illegal investments and 2.248 illegal online loans. There were 9.380 complaints about illegal entities received, including 8.991 complaints about illegal loans, and 388 complaints about illegal investments. 

Complaint handling needs to be further improved, "not only complaints and case handling, the government also needs to improve people's financial literacy so that people who are caught in debt do not increase," added Eka. 

This POJK has stipulated that obligations for implementing activities to increase Financial Literacy and Financial Inclusion are excluded for several PUJKs, namely Reinsurance Companies, Re-Guarantee Companies, Infrastructure Financing Companies, Employer Pension Funds, and Microfinance Institutions. 

"We hope that with this policy, people's rights to financial access will be better and protected," concluded Eka.
